SC’s stand to restore
collegium is a great move
The wisdom in the verdict of the Supreme Court to strike down the National Judicial Appointments Commission (NJAC) and continue with the Collegium system of judicial appointments needs to be respected. If legislators preach to civil society about respecting the supremacy of court decisions when it comes to imposing controversial government policies and programmes, they should also learn to practice the same. The attempts of the political parties to create an opinion against this recent verdict of the SC on the NJAC needs to be viewed with absolute caution, more so when there is agreement cutting across political party lines. As legislators are known to oppose and resent civil society participation in governance as an interference, it raises suspicion when they justify the same as a necessity in the appointment of judges. Terms like 'Civil Society' or 'Eminent persons' are vague when left to be interpreted by the government and more than often it is about rewarding eminent stooges of the political society. It is said: "The way to hell is always paved with roses."  As for the BJP which piloted this legislation, it can be expected that any disagreement with its thinking will get labelled as a confrontation, as an affront on the Parliament or an anti-national stance. Particularly in the present environment of State abetted hooliganism and terrorism against civil rights in this country, the attempts of the government to indirectly control the judiciary needs to be opposed by civil society.
